Spence pleaded guilty to fraud in an earlier case. He solicited individuals to invest digital assets such as bitcoin and ether between December 2017 and April 2019.

Spence fraudulently solicited more than $5 million in digital assets, including bitcoin and ether, from 175 user accounts.

Spence was sentenced to 42 month imprisonment in May.
